As globalization and digitization pose new antitrust challenges around the world for companies with cross-border relationship, authorities and lawmakers are forced to focus on and quickly catch up with new conceptual work, legislative initiatives and increased enforcement activities. Although E.U. Competition and U.S. antitrust laws cover most of the same subjects, rely on similar economic principles and have followed broadly similar conceptual approaches, a divergence appears to be in process. Differences are surfacing regarding treatment of algorithm-driven cartels, big data and resale restrictions. An international panel of antitrust law experts will address the myriad questions of how these new considerations affect businesses, explore the apparent enthusiasm of particular European enforcers to intervene or adjust competition law to keep pace with the fast-evolving digital economy.
