USTR Announces Additional Exclusions

On September 27, 2019, the U.S. Trade Representative (“USTR”) announced that 203 additional product descriptions will be excluded from the Section 301 trade remedies imposed on Chinese-origin products. The 203 exclusions consist of 92 product descriptions from Tranche 1 and 111 product descriptions from Tranche 2. This latest set supplements the exclusions the USTR previously granted. The list of 203 newly-excluded product descriptions is provided below. The exclusions will be retroactive to when the additional tariffs took effect – July 6, 2018 (Tranche 1) and August 23, 2018 (Tranche 2). The exclusions will apply to imported Chinese-origin products for one year after the exclusions are published in the Federal Register.

Chinese-origin products listed on Tranches 1 and 2 are currently subject to an additional duty of 25% ad valorem; the rate is scheduled to increase to 30% ad valorem on October 15, 2019. However, any Chinese-origin product that “meets the description” of an excluded product can claim the exclusion at entry and will not be subject to the additional duty.

The benefit is retroactive to the date the tariffs went into effect and therefore importers can correct prior entries, or claim refunds for Section 301 duties paid – to the extent that the liquidation on the earlier entry has not become final.

The USTR has indicated that it will continue to issue exclusion decisions concerning Section 301 products on a periodic basis. Although the exclusion request process has closed for Tranches 1 -3, the USTR has stated the process will open at a future date for Tranche 4.
